This privacy policy may change from time to time at our sole and absolute discretion, but it governs how we will use the data and information that we collect from you in your interactions with us consistent with this policy as it may be from time to time. Your use of this site (IslandH2OWaterPark.com) (“Site”) is also governed by the terms and conditions found here.

The water park (“Park”) is owned by Horizon Waterpark, LLC (“Horizon”) and managed by Premier Parks, LLC (“Management”) (Horizon and Management are “Us” or “We” or “Company”). This policy as it may be from time to time is binding on you and Us.

Information You Provide to Us:
Obviously, we collect the information that you provide to us. This includes by signing up for our mailing list, by sending us a message, by providing other information to us, and so on.

When you access our website, we collect technical information, such as your IP address, referring website, pages visited, the timing of page views, and the like.

To analyze customers’ use of the website and to perform trend monitoring, marketing, and advertising.

If Horizon (or its assets) are acquired, or if Horizon goes out of business, enters bankruptcy, or goes through some other change of control, your information could be one of the assets transferred to or acquired by a third party.

Is my information secure?
We use technical, organizational, and administrative security measures to protect all information we hold in our records from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Unfortunately, no one can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information.

To the extent you have an account, your account is protected by a password for your privacy and security. You must safeguard your password and computer/device, including by signing off when your account is not in use by you. Note that this website does not currently support the creation and use of an account directly, but may do so in the future and/or may through a third-party website related to this site, e.g. the commerce/billing function.

We usually use a vendor to handle the purchase of tickets/financial transactions so that we do not directly have access to or possess your financial information. Similarly, we do not currently directly handle web-posted questions or “ask us”-type questions. Rather, these are routed to us via a separate web platform. Your use of these websites, which look like part of our website but are actually not, are subject to those services’ terms of service/use and privacy policies.

​Use of video/audio and image booths/stations
Stationed throughout the park are booths/stations that record video, images and, at times, audio. The use of these booths/stations is governed by this specific policy.

You can always choose not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features. You may also choose in your browser settings, as discussed above, to control cookies.

Horizon, which is the owner of the site and the Park, is a company established under American law and its primary business is in the United States. Management is likewise an American company with its primary business located in the United States. We expect and intend any interactions with this website and us to be governed by American law and in particular the law of Florida without application of Florida’s choice of law rules. By using the website, you agree that the law of Florida applies to such use as if you were actually using the site while physically present in Florida, even if you are not physically present in Florida or even the United States. Likewise, you voluntarily agree to discontinue any suit that may, is, or could be brought in another jurisdiction than Florida, if such suit arises from or relates to this site or the park, i.e. the suit will be exclusively decided in and by the Ninth Judicial Circuit of Florida for state court or the United States District Court, Middle District of Florida, Orlando Division if the federal court.

By using the site and its services, including by buying tickets and supplying information to us, you agree to and waive the right to participate in and/or receive relief as part of a class action or representative action. Such class and representative waiver also includes without limitation, any arising from data breach, privacy claims, similar claims and the like.
